Terms of Service

Draft. This page is a placeholder and hasn’t been reviewed by a lawyer yet.

Last updated: [DATE]

These terms cover your use of Duh (the “App”) and duhkit.app (the “Site”). Duh is made by [LEGAL NAME](“we”, “us”), based in [COUNTRY]. By downloading, installing or buying Duh you agree to these terms.

1. Who sells Duh: Paddle is the Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is theMerchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy Duh, you buy it from Paddle, and Paddle’sbuyer terms also apply to your purchase.

2. Free trial

You can use every feature of Duh free for 7 days, without an account or payment details. When the trial ends, you need a license to keep using the App.

3. Plans and billing

  • Monthly and annual subscriptions renew automatically at the end of each period until you cancel.
  • You can cancel any time using the link in your Paddle receipt email. You keep access until the end of the paid period.
  • Founder lifetime is a one-time payment for a license that doesn’t expire. It’s a limited offer and may be withdrawn at any time.
  • Prices are shown on the pricing page. Taxes are calculated and collected by Paddle where required.
  • We may change prices for future billing periods. We’ll tell you in advance and you can cancel before the change applies.

4. Refunds

See our refund policy: 30 days, no questions asked.

5. Your license

We grant you a personal, non-exclusive, non-transferable license to use Duh on up to 2 Macs you own or control, for as long as your license is active. To check your license, the App sends a hashed machine ID, your license key and the App version to our license server, and nothing else (see the privacy policy).

You may not resell, share or publish license keys, or reverse engineer, modify or redistribute the App, except where the law allows it.

6. Your content

What you copy, capture or open with Duh stays on your Mac. We never receive it and claim no rights to it. You are responsible for making sure you have the right to process the content you use with the App.

7. Updates

We may release updates that add, change or remove features. The App checks for updates automatically. [CONFIRM: whether this can be turned off in settings.]

8. No warranty

Duh is provided “as is”. To the extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose. Keep backups of files that matter.

9. Limitation of liability

To the extent the law allows, our total liability for any claim relating to Duh is limited to the amount you paid for it in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.

10. Ending these terms

You can stop using Duh any time. We may end your license if you seriously break these terms.

11. Changes

We may update these terms. We’ll post the new version here and change the date above. Significant changes will be announced on the Site.

12. Governing law

These terms are governed by the laws of [COUNTRY], without affecting mandatory consumer protection rights where you live.
